Salman Khan approached the Delhi High Court on Monday to suspend the production, promotion and release of Kala Hiran: Battle for Legacy, a movie which has been in the making since it was announced earlier this month. The actor’s appeal comes as alleged evidence that the film was inspired by the blackbuck poaching case of 1998, in which Salman Khan was at the centre of it.
Salman Khan wants to stop all the work related to the film as it violates his identity and publicity rights, his legal team has said. The movie is unfair to him, and it does not respect his public image with all the prior legal history, and it makes a misleading association with it, and also, it's a reputational disaster, he said.
The controversy revolves around Kala Hiran: Battle for Legacy, a film produced by Amit Jani and directed by Bharat S. Shrinate. The film was inspired by the blackbuck hunting case dating back to 1998, when Salman Khan and several co-stars were accused of hunting protected blackbucks during the filming of the movie Hum Saath Saath Hain in Rajasthan. The case has continued to be one of the most debated ones by a Bollywood celebrity.
Before the High Court, Salman Khan’s legal team had already issued notices to the filmmakers for a halt in the development, promotion and release of the film. The notices also sought to get promotional material, posters and content relating to the film removed from the public domain. Because parts of the original case were still underway, any dramatised portrayal could prejudice public perception and interfere with judicial processes.
Kala Hiran makers, however, denied that the film is a biographical film of Salman Khan. Producer Amit Jani has said that the project is not a biopic and the film is about wildlife conservation, legal battles and social issues in general. He has publicly denied the notion that the film is about the actor directly and has said that the story is a story based on real-life events instead of a fictional recreation of Salman Khan’s life.
The dispute has received a lot of attention from the movie industry, where many observers regard it as an important test case for celebrity personality rights and the limits of creative freedom in cinema. Legal experts note that courts are often asked to weigh artistic expression against an individual's right to protect their identity, reputation and likeness from unauthorised commercial exploitation.
The film itself has also received a lot of attention as well. What was a very little-known and not very popular project became one of the most talked-about upcoming Bollywood movies. There are reports that filmmakers were planning to release promotional material and a teaser for the movie, but the legal battle will now potentially destroy that.
That is as the matter is currently before the Delhi High Court, and what is the future of Kala Hiran: Battle for Legacy? What is going to be the effect on the film and future work based on real-life controversies in the name of public figures, and how does that make the movie interesting? Salman Khan is likely to keep his film under pressure from the public and media, and will be at high risk when the film is released.
