A customs officer has been suspended for the case. The seizure has brought to light the methods of transporting gold into India without following customs regulations, as well as how authorities are looking for possible lapses in airport procedures.

The incident has raised the question of how Indian customs officials can handle the gold that is hidden in the air by international passengers. Dubai is an international trading centre for gold, and the flights between the United Arab Emirates and India are closely monitored for duty evasion and illegal gold transportation.

Passengers are routinely checked, luggage is examined, and intelligence-driven checks are conducted to check for smuggling attempts. Eight people recovered suggests the investigation has now turned to the reasons for their travel, the manner in which the gold was transported and whether they were doing so alone or in concert.

The value of the seized gold was around ₹9.9 crore, and this case is very important. Gold seizures of such size can trigger a very detailed probe of the source of the precious metal, its intended recipients and the financial transactions related to its transportation. Customs officials generally look at travel records, baggage contents, declarations and other evidence to find out if the travellers knowingly failed to comply with import duties and other customs laws. The exact quantity and form of the gold recovered in this case, however, should be confirmed by the government.

The suspension of a customs officer has added another dimension to the investigation. Although the department does at least have to see if there are any procedural lapses or concerns with the seizure, it would not lay the blame here alone. The investigators will have to determine whether the procedures were followed in the passenger screening process, whether any glitches occurred, and whether the officer was connected to the alleged smuggling activity. The findings of the departmental inquiry and any related criminal investigation will be key in establishing responsibility.

Airport gold smuggling cases can involve concealment via baggage compartments, clothes or other personal items. In some cases, gold is taken in forms so as to be less noticeable in the process of screening. Customs agencies use intelligence inputs, passenger profiling, scanning equipment and physical inspection to identify suspicious consignments. It is not clear what would have been the exact concealment method used by the eight passengers that the police are investigating to date and should not be assumed.

Gold imported into India is subject to customs duty, and passengers are obliged to abide by declaration and duty rules. Specific requirements, such as the passenger’s eligibility to travel abroad, quantity imported and the form in which the gold is carried, could be imposed if they do not meet the requirements and in some cases, they can be held responsible for the goods, face financial penalties and, in some cases, prosecution under the law. The difference between the legal status of such a permitted and illegal import and suspected smuggling is the facts of the case and the legal requirements based on which one would be considered.
