Minors under the age of 18 cannot be arrested and sentenced to prison in Brazil. This rule is supposed to provide young people an opportunity to make up for their mistakes and to avoid harsh punishment. But for police departments, such laws often frustrate the repeated behavior of unruly, youthful offenders. One recent illustration of this problem occurred when a young thief turned 18, and his birthday became a turning point in his life.
The boy had committed thefts and other offenses for years. Each time the police caught him, they had no choice but to let him go because of his age. In the community, he became known as someone who misused the laws. Although his victims took losses, he went free knowing he couldn’t be in prison. But everything changed on his 18th birthday. Finally, the police, waiting for this time, had the legal right to arrest him. And as the young man marked his birthday, the officers celebrated joyously. To them, it wasn’t only a matter of catching one criminal, but also obtaining justice after years of waiting.

Brazil’s law against imprisoning minors is based on a belief that young people should be provided with opportunities for reform. Instead of being put behind bars, young people are often sent to juvenile centers where they can get education and guidance. The aim is thus to keep them from developing into a life course of crime and delinquency. But at the same time, others argue, some youths abuse that protection, committing crimes repeatedly before adulthood.
The arrest was symbolic. The police had followed his activities closely, aware that once he was 18 they were able to act. He was arrested on that day and placed in jail. To the officers, it was a win. For the thief, it was the end of his freedom and the start of something new.
This case captures the balance between protecting young people and justice for society. The law may give minors a chance to reform, but it also allows for abuse. The thief’s 18th birthday turned into an emotional roller coaster of sadness for the thief, and celebration for the police who saw justice rendered for once.
