The National Commission for Women (NCW) has suo motu taken into account a disturbing incident involving harassment, assault and wrongful restraint in Jamui district in Bihar. This was motivated by the viral video we saw on social media that indeed recorded the disturbing event in the region.
From this shocking incident, NCW Chairperson Vijaya Rahatkar has instructed the DGP of Bihar to take immediate and effective action. The Commission has recommended that the state police have to register a First Information Report (FIR) immediately and that the FIR should be filed with the department as soon as possible. The Commission also requested the identified persons to be identified for those in the incident according to the available video footage and urged the police to take the necessary steps to arrest those involved and to investigate them.
Not only does the NCW call for immediate response but also a thorough and time-bound investigation into the allegations. A detailed Action Taken Report (ATR) should be submitted within seven days to Bihar authorities to report back to them on what took place in a manner that is in line with the Commission’s recommendations, and that is to emphasize the NCW's motivation to have accountability and transparency in dealing with such serious matters.
The Commission is also concerned for the victims’ welfare and has taken steps to protect them. The victims are supported, and the criminal and legal process is being done to ensure that they are protected and supported during the investigation process.
Another aspect of NCW's intervention is that its concern is about the spread of the objectionable video footage. The Commission has asked the Government to act immediately to stop the dissemination of the material, and this case is especially sensitive since the victims are minors. The risk of further victimization from the circulation of such material is very serious, and we need to act immediately.
The incident had taken place on the night of September 19 in Jamui; a teenage boy and a girl heading to their coaching classes had been intercepted by a group of people. The videos that were released online in such cases were seen by police to show the couple being surrounded, harassed, and assaulted. Local police took action on the video, and the culprits were brought to justice.
The Jamui police have so far made a lot of progress in the case. As of now, three people have been arrested, and the police have identified about seven more suspects suspected of being involved in the incident. The search for those who are still at large continues. To give a more focused investigation, a Special Investigation Team (SIT) has been established in order to deal with the viral nature of the video and related activities.
The police were able to trace the victims through the video and what they gathered. The police have since kept records of the victims and witnesses as part of the investigation.
The NCW’s intervention adds a crucial layer of oversight to the police investigation that places victims’ rights first and the full-fledged response in place. With the Action Taken Report due to be completed within seven days, the women’s rights body has highlighted the need for accountability from the Bihar government and asked for a clear picture of the responses made to its directive.
This case has attracted widespread attention due to the vicious nature of the assault but also because the incident was recorded and posted online. As authorities work with this issue, they are confronted with two interconnected aspects: the immediate assault and harassment as well as the wider impact of the video’s dissemination.
The NCW has consistently supported the identification of the accused and prosecution according to the law while advocating for their protection and assistance. The seven-day deadline imposed by the NCW puts even more pressure on Bihar authorities to provide an Action Taken Report on how they react to this serious incident. As the investigation continues, more arrests may be made as police are trying to find the remaining suspects.
