A Lookout Circular is an administrative procedure used by authorized law enforcement agencies to inform the Bureau of Immigration of persons who are needed in relation to an investigation or legal process. Depending on the procedures put forth by the originating agency, immigration officials might detain the individual, prevent departure, and inform the investigating agency if the person goes abroad. It is not a warrant by and of itself.
According to reports, the LOC was issued in the name of Senthil Balaji as the Central Department is investigating him. The reason behind the latest move is not yet known, but the circular is to make sure that the person is still under investigation and has a legal route to go. There is no official word of any attempt to leave the country till now.
The Bureau of Immigration creates Look Out Circulars based on requests from the Enforcement Directorate (ED), Central Bureau of Investigation (CBI), police, and other relevant agencies. LOCs that are issued are passed on to immigration checkpoints at international airports, seaports, and land border crossing points in India.
The legal framework governing Look Out Circulars has been under judicial review for years. The Supreme Court has observed that while such circulars are important for investigating, they also affect an individual's right to travel and therefore need to be issued in a manner that is evidence-based and protects the human rights of the individual. All such circulars must be openly provided, and standard operating procedures should be explained.
The reported LOC has drawn a lot of political attention in Tamil Nadu, where Senthil Balaji is already a well-known politician. People are calling for due process, and political opponents are calling for action. Political leaders have refused to comment on the situation until they know what is going on with the investigation.
The issuance of a LOC does not prove guilt or innocence, but rather is intended to ensure that a person does not leave the country in a way that could hinder an ongoing investigation or judicial proceedings. Any further action will depend on the progress of the investigation, court proceedings, and decisions taken by the competent authorities.
