Battle Over 'Jana Nayagan': Makers Move Supreme Court After High Court Stays CBFC Certification for Vijay's Political Epic

Well, the legal fight has reached the top of the Indian judiciary as Thalapathy Vijay's awaited political drama, Jana Nayagan, has taken up the courts of the state. On January 12, 2026, the film’s producers lodged Special Leave Petition (SLP) in the Supreme Court of India, invoking how they obtained and contested a recent High Court order that suspended the Central Board of Film Certification (CBFC) process for the film.

The High Court Intervention

The matter has stemmed from a ruling last week by the Madras High Court to hold a censor certificate for the film. The stay was issued in relation to a Public Interest Litigation (PIL) alleging that some of the dialogues and sequences in Jana Nayagan's teaser were "provocative" and had the potential to produce unrest and "malign the image of the existing political institutions." The High Court had held that while freedom of expression is a fundamental right, such rights must be curtailed reasonably where they concern sensitive ideas and should not compromise public order. 

The Makers’ Pick: “An Attack Upon Creative Freedom.”

The production house and director of Jana Nayagan have objected that the High Court's stay of the certification is a 'too harsh' intervention at a 'proactive and premature stage' in the film certification process. They argued in their petition to the Supreme Court: In so doing, they claim, they are exercising "judicial overreach" and exercising "pre-censorship" when they go ahead not before CBFC has even had the chance of review and reviewing the certified movie.

The CBFC Role

They contend that the CBFC is a dedicated statutory authority with people who can determine if a film meets the terms of the Cinematograph Act, 1952. Legal commentators have contended that the Apex Court is often sympathetic to the protection of the freedom of film, and commonly says that once the statutory body such as the CBFC clears a film, any judicial interference in such a case should be minimal. If the Supreme Court lifts the stay, the film will revert to CBFC for final grading (U, U/A or A). But in that case if the stay lingers, the producers could be required to push off the release date, impacting thousands of screens worldwide.
