The Supreme Court has stayed the Madras High Court’s order that gave a complete ban on cow slaughter in Tamil Nadu. The decision came after the Tamil Nadu government challenged the High Court’s order which went beyond the provisions of the state’s existing animal preservation law.
The case is about the interpretation of the Tamil Nadu Animal Preservation Act, 1958, which governs the slaughter of cattle in the state. The Tamil Nadu government told the Supreme Court that the law does not ban cow slaughter in general but only for specific circumstances.
The Act permits cows over 10 years old to be slaughtered if they are unfit for agriculture or breeding purposes, he said. But unless the slaughter is done by law, according to the rules.
The government said while the state does have regulations in place to protect cattle and prevent illegal slaughter, these are not sufficient to prohibit all cow slaughter activities.
The legal battle started when the Madras High Court issued an order for the complete ban on cow slaughter in Tamil Nadu. The law was questioned when the court extended existing laws far beyond what the state government had decided in the past.
The Tamil Nadu government took the High Court’s decision to the Supreme Court to challenge the ruling that was contrary to the Tamil Nadu Animal Preservation Act. The Supreme Court rejected the High Court’s view, stating that the legislation already takes a balanced approach of protecting the cattle and allows for limited exceptions under specific circumstances, the state argued.
The Supreme Court’s stay means that the Madras High Court’s complete ban order will remain suspended until the matter is further investigated. The Supreme Court will then rule on the scope of state laws and whether a complete ban can be imposed when existing legislation allows regulated exceptions.
This can be examined by the Supreme Court whether slaughter linked to a particular festival be allowed or not and then the condition mentioned in various Acts to apply on case to case basis.
