A 34-year-old remand prisoner Sabari Varman died in a prison in Tamil Nadu’s Kanniyakumari district after being arrested in connection with the sale of banned tobacco products near Nagercoil, Tamil Nadu, for which a jailhouse and police investigation is being carried out. The death has also brought attention to prison care, custodial and legal protections for people in custody.
According to officials, Sabari Varman was arrested by law enforcement authorities for selling prohibited tobacco products in the Nagercoil region. After his arrest he was brought to court where he was remanded to judicial custody. He was later sent to prison for further investigation. His health deteriorated while in prison so prison officials arranged for medical care.
The prison staff immediately recognized his condition and took him to a hospital for treatment, officials said. But he was declared dead despite the efforts of medical care. The cause of death is not yet officially known and a post-mortem examination will be necessary to determine what caused the death, as a medical reason of death.
As in all such cases involving deaths in judicial custody, a probe has been initiated. Judicial custodial deaths are subject to legal scrutiny and different agencies may come to investigate what happened. Prison records, medical reports, CCTV footage and statements by prison officials and other inmates will be examined as part of the investigation.
Police officials stressed that the inquiry is for establishing the facts of the death and conclusions can’t be drawn until the investigation and forensic examination are complete. Investigation findings and any other evidence from the post-mortem report (and other evidence) will determine whether the death was natural or related to medical conditions or other reasons that can be addressed further.
The incident has once more put the attention on judicial custody and treatment of those in judicial custody. Prisoners and remand prisoners are still entitled to life and access to necessary medical care that is guaranteed by the law, legal experts say. Prison authorities operate to monitor the health of prisoners and provide timely medical care in case of medical emergency.
Human rights organizations have frequently promoted transparent investigations into custodial deaths. They argue that prompt judicial investigations, independent medical examinations and public disclosure of the findings of investigations help to build accountability and public confidence in the justice system. Families of inmates should also be given the opportunity for the information about that incident through the legal system.
Tamil Nadu has instituted procedures concerning custodial deaths, such as reporting, judicial investigation, and post-mortem examinations as per law. These are to bring the situation to the public and to determine whether any errors and/or lapses in judgment or procedures led to the incident.
The death of Sabari Varman also raised broader questions about prison infrastructure, inmate healthcare and the need for prisoners to be regularly examined for health problems. Early identification of health problems, adequate staffing and referral to specialized hospitals can be key to preventing preventable deaths in correctional institutions, experts say.
Meanwhile, the authorities are confident that the investigation will be conducted fairly and appropriate action will be taken if any irregularities are found. The prison administration will cooperate in all the relevant records needed for the investigation, the report says.

Family members will wait for the post-mortem examination and the official investigation to determine if there will be any further legal action. The results will be very important to establish the sequence of events leading up to the death and to decide whether further action or accountability should be taken.
And officials have appealed to the public to not speculate but to rely on official reports. That case is a lesson that healthcare, transparency and the requirements of a court system are very much relevant to this case as custodial deaths are being investigated and legal measures to prevent abuse are implemented.
