Bhopal: The Madhya Pradesh government is preparing to defend before the Supreme Court its decision not to sanction the prosecution of senior cabinet minister Kunwar Vijay Shah for his controversial comments about Army officer Colonel Sofiya Qureshi. The matter has raised a huge political and legal storm, and the state government has to explain to the court why it does not believe criminal prosecution of the minister is justified; the government of Madhya Pradesh is now expected to say why it does not believe that the minister should be punished by court and why it must not prosecute Kunwar Vijay Shah.
The government will argue some of these arguments in the Supreme Court. The defence of the government will be that there is no evidence for sanction for prosecution. One of the critical arguments will be that nobody came forward to lodge a private complaint against Shah after his controversial comment. The government will argue that despite the widespread political reaction of the country to the minister and the public’s criticism there was no private complainant calling for criminal actions against the minister.
Shah did not mention Colonel Sofiya Qureshi in the statement. The government argues that the comments were not intended to insult Qureshi or to target any individual. An important part of the state’s explanation before the court is how to distinguish between an objectionable statement and one that, in its view, attracts criminal liability.
The state government is also relying on Shah’s subsequent apologies. According to the proposed defence, the minister apologised multiple times and also expressed regret in writing after the controversy erupted. The Cabinet has taken the position that repeated expressions of regret should be considered when deciding whether there are adequate grounds to approve prosecution.
The government has also described the incident as a human error, as opposed to a malicious action. The argument is that Shah’s subsequent apologies, together with what it says is nothing but his lack of malicious intent, should justify the case for criminal prosecution.
A part of the government's position is on communal harmony. The state believes Shah's remarks did not lead to an actual breakdown of communal peace and that Shah himself had no intention of making communal unrest. So it is highly likely that such an argument will be examined because the controversy has raised questions about the consequences of remarks by public representatives.
The Cabinet of Chief Minister Mohan Yadav on 25 August decided not to accord sanction for Shah's prosecution. The recommendation was then sent to Governor Mangubhai Patel, who approved the Cabinet decision. The state government will now defend that decision in court in the coming days as legal disputes over the matter continue.
But the dispute is bigger than the legal ones. Shah's political importance in Madhya Pradesh is a major factor in why the government is now defending its decision so passionately.
Vijay Shah is one of the BJP’s most experienced leaders in Madhya Pradesh. He has won eight consecutive Assembly elections since 1990 and has been a key figure in state politics for more than three decades. He has been in different governments and has various important portfolios during his political career.
Shah has been head of the Tribal Welfare Department on several occasions and has been responsible for Forest, School Education, Tourism and Culture, and Food and Civil Supplies. His long-term service in government has established him as one of the party’s most powerful leaders with a strong organisational and electoral network.
His position in Madhya Pradesh is also significant because the tribal communities of Madhya Pradesh are very important. Shah belongs to the Rajgond community and is well known as a tribal face of BJP in the state. Madhya Pradesh is a tribal state and Scheduled Tribes are very much at the center of elections in different parts.
Shah’s political history adds another dimension to it. For decades, he has held Harsud and regions around it, winning eight consecutive Assembly elections. That record has helped him build a solid political base and a network that extends beyond his constituency.
In the short term, taking action against Shah can have a political impact for the BJP government. If it wants to remove him from office or distance itself from him, it could damage the party with some of its tribal supporters. And his political background and his stature make it so difficult to treat him as an ordinary party functionary.
Shah has been the subject of controversies in the past too. In 2013, he was removed from the Madhya Pradesh Cabinet after some comments on women at an event in Jhabua. But the Cabinet only lasted a few months before he returned to ministerial office.
In May 2025, the latest controversy began when a video showing Shah making offensive comments about Colonel Sofiya Qureshi was aired in a media conference. Qureshi had already attracted the attention of the public in media briefings on Operation Sindoor and is therefore especially sensitive.
The Madhya Pradesh High Court took suo motu cognisance of the matter, criticized Shah and directed the police to register an FIR against him under provisions including those related to promoting enmity and hatred. The development turned the controversy from a political dispute into a real legal matter.
The case eventually came to the Supreme Court which sought a status report from the Special Investigation Team established by the Madhya Pradesh government. Shah also issued apologies after the episode. But the Supreme Court later questioned the quality and sincerity of his apology.
So the state’s decision not to prosecute has become a matter of political accountability, executive discretion and criminal law. And now the government is about to explain itself before the country’s top court while its controversy has not dissipated.
The Supreme Court will ultimately determine the repercussions of the state’s decision in the bigger legal arena. And for the Madhya Pradesh government, it will be hard enough to prove that it made a legal decision in this case and not political calculations. Shah, for his part, will also have to contend with another major test of his political career, which has already been rocked by controversies over the years.
