Karnataka Government to Bring Legal Reforms to Resolve Apartment Owners' Issues, Says DK Shivakumar

Karnataka Chief Minister D K Shivakumar has assured apartment owners across the state that the government is developing a legal framework to deal with long-standing problems in property ownership, apartment governance, registration, and civic infrastructure.

In a meeting with apartment owners in Bengaluru, he told apartment residents about the hardships faced by thousands of apartment owners and said the government will introduce reforms to provide clarity in terms of legal clarity, better residents’ rights, and better control over apartment communities.

Focus on Property Ownership

One of the main concerns of apartment owners has been the difficulty of getting proper ownership documentation and transferring property records into their names.

Shivakumar also highlighted the government’s Bhu Guarantee initiative to simplify property ownership procedures and make land and apartment ownership records more transparent through digital systems.

His plan will help ensure property owners have legal documents for ownership, he said.

"Through the Bhu Guarantee initiative, we will ensure your property is transferred to your name," said the Chief Minister.

Legal Reforms on the Way

All these are some of the problems faced by apartment residents, according to the proposed legislation.

Property registration and ownership rights. Apartment governance and management. Residents' Welfare Associations (RWAs). Civic infrastructure and maintenance. Builders and developers accountability. Resolution of legal disputes involving apartment communities.

The government believes that a stronger legal framework will help reduce disputes between developers, apartment associations, and homeowners while ensuring greater transparency.

Consultations Before Final Law

Shivakumar stressed that the proposed law would not be drafted in isolation. The government will have discussions with apartment owners, residents’ associations, legal experts, and other stakeholders before finalising the legislation.

Public participation is crucial to ensure that the new legal framework is in place and the real problems faced by apartment communities are addressed, according to him.

Action Against Violations

The Chief Minister also said that the government would enhance enforcement against violations of apartment construction and management.

Many officials will put more regulations in place on builders’ actions to ensure that approved plans are carried out and that builders are meeting their legal obligations to homebuyers.

The proposed reforms will also improve transparency in apartment administration and homeowners’ rights.

Growing Apartment Population

With Bengaluru at the forefront of rapid urbanisation, apartment living is the preferred housing for lakhs of families. Still, residents are faced with issues regarding ownership documentation, maintenance responsibilities, civic facilities, parking problems, and builder issues.

Many apartment associations have long pushed for updated legislation to address these concerns and to provide clearer legal safeguards.

Towards Better Urban Governance

The proposed reforms in Karnataka are expected to enhance the functioning of apartment communities and property ownership to be safer and more transparent from a legal perspective.

If implemented properly, the new legal measures could benefit thousands of apartment owners across Karnataka by simplifying property registration, strengthening governance mechanisms, and ensuring better coordination between residents, developers, and government agencies.

The government will consult with stakeholders before it puts the proposed legislation to the public for further discussion, he said.
